Oswald was 5'9" while Ruby was 5' 8 1/2".  So, for all practical purposes, they were the same height. A half inch difference would be hardly noticeable- especially in a photograph.

So, how do you account for the short stature of that guy? I'll tell you how: he wasn't Jack Ruby.
